In consideration for permission to participate in "Personnel Activities" offered by Sunergy, I, the undersigned, agree to the terms of this Assumption of Risk and Release of Liability ("Agreement"). Personnel Activities include my use of recreational and eating facilities at Sunergy or a Sunergy activity (including the fitness center, pickle ball court(s), table tennis, cafeteria, skating half-pipe, simulators such as a golf simulator, and exterior grounds), and participation in voluntary company activities (e.g., team events, team activities, service activities, or other activities beyond performing my assigned job tasks).
I acknowledge my participation in Personnel Activities is optional. I understand there are health, safety, and property risks to participating in Personnel Activities, which include cuts, bruises, broken bones, sprains, falls, drowning, concussions, internal injury, cardiac or respiratory failure, stroke dehydration, emotional distress, injuries caused by or from colliding with other participants or objects or equipment, misuse or failure of equipment, loss of or damage to personal items, communicable disease, and other risks, hazards, or accidents, whether foreseen or unforeseeable. The above list is not inclusive of all possible risks associated with Personnel Activities and does not way limit the scope of this Agreement. I voluntarily assume responsibility for all risks and hazards associated with participation in Personnel Activities, including personal injury, paralysis or death, and property damage or loss.
I hereby knowingly and intentionally release, hold harmless, and covenant not to sue Sunergy, its parent companies and each of their subsidiaries or affiliated companies, and each of the foregoing companies' directors, successors, assigns, officers, managers, employees, volunteers, contractors, and agent(the "Released Parties"), from and for all claims of loss, damage, or liability, including claims of personal injury, paralysis or death, and property damage or loss, which may result from my participation in Personnel Activities. I acknowledge that injury or damage may be increased by negligent rescue operations or other actions, inactions, or procedures of the Released Parties or other persons, and agree this Agreement extends to all such acts or omissions. This waiver of liability is effective even if the damage, injury, or loss results from the negligence or omissions of the Released Parties.
I certify I have sufficient skills, training, and physical and mental health and stamina to safely participate in Personnel Activities. I authorize Sunergy or its agents to administer emergency care to me for any accident or illness (physical or mental). I understand and agree I am responsible for any expenses incurred for such care, including transportation and medical costs. For the purpose of providing medical care to me, I authorize medical providers to disclose my protected health information to Sunergy staff or others involved in providing medical care to me. Insurance. I assume responsibility for obtaining personal insurance coverage and paying for health care expenses related to or arising from my participation in Personnel Activities, including expenses incurred by Sunergy or its agents on my behalf.

I agree to comply with any rules and policies applicable to Personnel Activities, this Agreement, posted facility or equipment-specific requirements, and any other rules and policies communicated to me by Sunergy, its agents, in any form ("Policies"). I understand that Policies are subject to change at Sunergy's sole discretion for a variety of reasons, including health and safety. I understand that if I do not comply with applicable Policies, my ability to participate in Personnel Activities may be restricted or terminated.
I will immediately notify Sunergy staff of any injury I sustain while participating in Personnel Activities. I will act with reasonable care in using Sunergy property or property or facilities leased or borrowed by Sunergy or its agents and I will immediately advise Sunergy staff if I cause or notice any damage to Sunergy property.
This Agreement is binding upon me, my spouse or domestic partner, my child(ren), next of kin and any other family, and any of our successors, assigns, heirs representatives, executors, legal guardians, and administrators. If an Agreement provision is determined invalid for any reason, such shall not affect the validity of other provisions, which shall remain in effect as if this Agreement had been executed without the invalid provision.
I have read and understand this Agreement and understand that by signing below I choose to give up substantial rights, including the right to sue. I declare I am of legal age (at least 18). I affirm I voluntarily agree to all the Agreement terms.
